    Follow up question on the definitions of misconduct and substantial fault from the DWD:
    The definitions of misconduct and substantial fault are defined in the law and this is a link to that statute section: . This is really the most clarification we can provide as it is the only clarification we were given by the legislature. All discharges are reviewed on a case-by-case basis and adjudication staff must first consider if the discharge was for misconduct. If misconduct cannot be established, they would then look at substantial fault which provides a slightly lesser penalty for the claimant.
